Despite the High Court’s ruling, Japan’s current marriage law still restricts marriage to heterosexual couples, highlighting a legal discrepancy that needs to be addressed by the government. The court’s decision underscores the urgent need for legislative action to rectify this inequality and ensure equal rights for all citizens, regardless of sexual orientation.

The ruling by the Sapporo High Court emphasized that denying same-sex couples the right to marry and enjoy the same benefits as heterosexual couples violates their fundamental rights to equality and freedom of marriage. Judge Kiyofumi Saito highlighted the importance of recognizing the constitutional freedom of marriage as applicable to all individuals, irrespective of their sexual orientation. The court emphasized that allowing same-sex marriage poses no harm or disadvantage to anyone and is a matter of basic human rights.

 

This ruling is particularly significant as it marks the first time that Japan’s current marriage law has been deemed unconstitutional by a high court. Previous court decisions in various cities have also challenged Japan’s policy of denying same-sex marriage, but this ruling represents a notable step forward in the legal recognition of LGBTQ rights in the country.

 

Japan’s status as the only member of the Group of Seven nations that still excludes same-sex couples from the right to legally marry and receive spousal benefits underscores the urgency of legal reform in this area. While Japan’s conservative government has faced criticism for its perceived reluctance to embrace diversity and promote LGBTQ rights, recent surveys indicate a growing shift in public opinion. A majority of Japanese citizens now support legalizing same-sex marriage, reflecting changing attitudes towards LGBTQ issues within Japanese society.
